Item 1. Summary of Proposed New Rules re: Consumable Hemp Products
ENGLISH: TABC proposed new rules 16 TAC §35.5 and §35.6 to carry out Governor Abbott’s Executive Order GA-56 (Sept. 10, 2025). The proposed rules prohibit a TABC licensee or permittee from selling consumable hemp products (CHP) to minors and require them to verify a consumer’s age by checking the consumer’s government issued identification prior to completing the sale of CHP. A licensee or permittee that violates these rules may have their license or permit suspended or cancelled, as provided in the proposed rules.
SPANISH: TABC propuso nuevas reglas 16 TAC §35.5 y §35.6 para llevar a cabo la Orden Executiva GA-56 del Gobernador Abbott (10 de Septiembre de 2025). Las reglas propuestas prohíben que un licenciatario o poseedor de permiso de la TABC venda productos de cañamo consumibles (CHP, por sus siglas en inglés) a menores y requieren que verifique la edad del consumidor revisando una identificación emitida por el gobierno antes de completar la venta de productos de cañamo consumibles. Un licenciatario o poseedor de permiso que viole estas reglas puede tener su licencia o permiso suspendido o cancelado, según lo establecido en las reglas propuestas.
Note: These proposed new rules, if adopted, will replace TABC's current emergency rules on consumable hemp products (i.e., Rule 51.1 and Rule 51.2). The proposed new rules are similar to the emergency rules except that the proposed new rules provide addition penalty options and provide license and permit holders with a defense to TABC enforcement action.

Item 2. Summary of Proposed New Rule and Amended Rules re: Audit
ENGLISH: TABC proposes to amend rules 16 TAC §41.37, §41.43, §41.50, §41.52, §41.53 and §41.65 to fix clerical errors and clarify current agency practices related to regulated entities that are required to keep records and/or file reports for taxation purposes. The proposal also relocates a subsection from §41.53 to proposed new rule §41.57, though the language has been revised for clarity.
SPANISH: TABC propone enmendar las reglas 16 TAC §41.37, §41.43, §41.50, §41.52, §41.53 y §41.65 para corregir errores administrativos y aclarar las practicas actuales de la agencia relacionadas con las entidades reguladas que están obligadas a mantener registros y/o presentar informes con fines fiscales. La propuesta también reubica una subsección de la regla §41.53 para proponer una nueva regla §41.57, si bien el texto se ha revisado para mayor claridad.

Item 3. Summary of Proposed Amended Rules re: Marketing Practices
ENGLISH: TABC proposes to amend rules 16 TAC §45.130 and §45. 131 to fix clerical errors and clarify current agency practices and statutory requirements related to cash and credit transactions between alcoholic beverage retailers and wholesalers or distributors.
SPANISH: TABC propone enmendar las reglas 16 TAC §45.130 y §45. 131 para corregir errores administrativos y aclarar las practicas actuales de la agencia y los requisitos legales relacionados con las transacciones en efectivo y a crédito entre minoristas y mayoristas o distribuidores de bebidas alcohólicas.
