On-premises licensees and permittees may sell alcohol on Sunday between 10:00 a.m. and 12:00 p.m. with the service of food. However, licensees and permittees located at a “sports venue” or at a festival, fair, or concert may sell alcohol beginning at 10:00 a.m. on Sunday without the service of food.</p>\n\n<p>A \"sports venue\" means a public entertainment facility property which is primarily designed and used for live sporting events. A \"public entertainment facility” means an arena, stadium, automobile race track, amphitheater, auditorium, theater, civic center, convention center, or similar facility that is primarily designed and used for live artistic, theatrical, cultural, educational, charitable, musical, sporting, nationally sanctioned automobile racing, or entertainment events. Unlicensed private event hosts/organizers must ensure that no alcohol sales take place at the event. If alcohol is provided to consumers for free a license or permit is not required. The agency’s longstanding position has been that to be “free,” the alcohol must be made available upon the request of any non-intoxicated person at least 21 years of age, regardless of whether the person has paid a membership fee, entrance fee, door charge, meal charge, ticket price, or any other fee for the event. The organization may not require donations or tips or otherwise require money in exchange for alcoholic beverages served during the event.</p>\n\n<p><strong>TABC recommends the following best practices: </strong></p>\n\n<ul><li>The event should have measures in place to ensure the safety of guests and that alcohol is served and consumed responsibly. </li>\n\t<li>The event must take place outside of the licensed portion of a hotel or convention center, or in an otherwise unlicensed venue, area, or location. </li>\n\t<li>Events should be “by invitation only” and controlled by security to ensure the event remains private. </li>\n\t<li>Be aware of Chapter 2 of the Alcoholic Beverage Code pertaining to civil liability for serving alcoholic beverages.  </li>\n\t<li>If the event is being held or sponsored by an upper tier member, please refer to <a href=\"https://www.tabc.texas.gov/static/sites/default/files/2020-06/mpb-017.pdf\" target=\"_blank\">Marketing Practices Advisory No. 17</a> for additional information and guidance.      <br />\n\t </li>\n</ul>"}}}]}},{"entity":{"__typename":"Drupal_ParagraphHeading","entityId":"6233","entityBundle":"heading","fieldHeadingCopy":"Retailer Entertainment","fieldHeadingType":"Large"}},{"entity":{"__typename":"Drupal_ParagraphAccordion","entityId":"6235","entityBundle":"accordion","fieldAccordionItem":[{"entity":{"__typename":"Drupal_ParagraphAccordionItem","fieldAccordionHeader":"What are the rules for upper tier members providing retailer entertainment?","fieldAccordionText":{"processed":"<p>Section 45.110 of the Texas Alcoholic Beverage Commission’s Administrative Rules limits the value of food, beverages, entertainment and recreation provided to a retail employee by an upper tier member to $1,000.00 per person on any one occasion. </p>\n\n<p>Upper tier members may provide retailers up to $1,000 dollars in value, per day.
